PROTECTION AND USE OF PERSONAL DATA
UVVE UNIVERSIDADE LIVRE DE CIÊNCIAS HUMANAS DE SÃO PAULO is committed to the importance of privacy and the protection of personal data, contributing to the public debate with a view to building a culture on the subject in Brazil. UVVE strives to contribute as much as possible to the development of quality teaching and research in Brazil. It has innovative initiatives in various fields of social sciences, including acting as an important interlocutor on this subject in the country. Considering that in 2018 Law No. 13,709/18 was sanctioned – General Law for the Protection of Personal Data – LGPD, UVVE created this page that aims to clarify how we protect and use the data of students, partners and website visitors.
Your rights
The LGPD brought important rights that you (the data subject) can exercise before UVVE or any other public or private institution that uses your personal data, such as your name, registration data, and others. In this sense, UVVE is committed to being an agent that promotes the importance of rights related to privacy and the protection of personal data, contributing to the public debate with a view to building a culture on the subject in Brazil. In this space, you will find some information about the LGPD and UVVE's work in the area of personal data protection.
Main data processed
Visiting the UVVE Portals:
Through cookies, information about the browser may be stored, such as the browser and version used, behavior on the Portals, monitor settings, among other information that is not necessarily of a personal nature, and IP address.
Restricted use areas:
- IP number, data stored by cookies, full name, UVVE access account, email address, password, date and time of access.
- These areas may contain additional personal data, not disclosed in this Notice, which are strictly necessary for their regular use. Access to these areas is only permitted through a login directly granted by UVVE and a password registered by You.
UVVE has electronic Portals that aim to disseminate and communicate various contents, including information, activities, news, events, research, publications, books, photos, videos, activities on social networks, among other texts and disclosures that are necessary.
UVVE is committed to the duties of privacy and protection of personal data, and the purpose of this Privacy Notice is to clarify, in a simplified and accessible way, how personal data is processed when You use the Portals, in accordance with Law 13,709/2018 (LGPD).
This Notice must be read and interpreted in conjunction with the UVVE Portal Cookie Notice. If you disagree with any term, please do not use any UVVE Portal.
Furthermore, if you access any restricted area, it is possible that it has its own Terms of Use, Privacy Notice and Cookies Notice documents, which, in this case, should be read together with this Notice. In the event of conflict, the provisions contained in the respective document for the restricted area will prevail.
Personal data collected and Responsible Institution
UVVE will be the Controller of Your personal data, that is, responsible for making all decisions related to processing, and may collect different types of data and personal information from You, depending on how You use the Portals.
Visiting the UVVE Portals
Allow browsing through the Portals and viewing information, activities, news, events, research, publications, books, photos, videos and activities on UVVE's social networks.
Type of personal data
Through cookies, information about the browser may be stored, such as the browser and version used, behavior on the Portals, monitor settings, among other information that is not necessarily of a personal nature, and IP address.
Registration for marketing campaigns
Purpose: UVVE may send marketing campaigns, upon voluntary registration, by the User, expressing interest in its products, courses, events and/or for institutional promotion and publicity purposes.
Type of personal data
Full name, telephone number, email address, institution to which you may be linked, city and state.
IP number, data stored by cookies, full name, access account, email address, password, date and time of access.
These areas may collect additional personal data, not disclosed in this Notice, which are strictly necessary for their regular use.
Access to these areas is only permitted through a login directly granted by UVVE and password.
Depending on the type of form, the CPF number or other relevant information may be requested.
PRIVACY AND PERSONAL DATA PROTECTION TERMS OF THE STANDARD EDUCATIONAL CONTRACTS OF UVVE SCHOOLS
The purpose of this Agreement is to make the general parameters for the use of personal data of Students enrolled in Courses taught by Schools maintained by the Universidade Livre de Ciências Humanas de São Paulo – UVVE transparent. By enrolling in one of the aforementioned courses, the Student agrees to the conditions set forth in this Agreement, as stipulated in his/her contract. In addition to the contractual provisions, UVVE reserves the additional prerogative of requesting the Student to express electronic acceptance of this document.
Presentation
UVVE protects the Student's rights to Privacy and Personal Data Protection in accordance with this Term, applicable laws and regulations, especially those originating from the Ministry of Education and/or the National Personal Data Protection Authority – ANPD, also observing the clauses below.
Applicable Legislation and Definitions
The expressions used in this Term will be defined according to the meaning attributed by Law 13.709/2018 (General Data Protection Law, hereinafter “LGPD”). In addition:
An information security incident will be considered as any occurrence connected to personal data that may cause damage or expose their respective Holders to relevant risks, compromising the confidentiality, integrity or availability of such data.
Platforms or software used for educational purposes will be understood as electronic solutions used in the teaching-learning process and/or in academic management offered by UVVE or by linked partners.
Related holders are natural persons who have a connection with the Student and whose personal data needs to be shared with UVVE due to the contractual relationship, such as guarantors, financial managers or contractual co-obligors.
Controllers or Co-Controllers refer to entities that, in the context of a contractual relationship, can define how the Student's personal data will be processed within the academic context.
Main Treatment Agents
For the purposes of applicable legislation and this Term, UVVE will be considered the Processing Agent for the personal data of the Student and any Related Holders, and may act as:
Controller of personal data, fully determining the processing of data in accordance with current legal and regulatory requirements.
Co-controller of personal data in situations where it receives data from Controllers with whom the Student has a link (educational institutions, employers, financiers, etc.).
Operator of personal data in cases where the course is offered in closed classes contracted exclusively by third parties.
International Sharing and Transfer of Personal Data
The Student is aware that, in order to fulfill academic purposes, UVVE may share their data with other necessary institutions, which will act as Operators or other entities authorized by the Student.
International transfers will occur as provided for in the LGPD, especially in Chapter V.
If the Student participates in exchange programs, the partner Educational Institution will be responsible for processing their data.
If the Student's course is financed by third parties, academic reports may be shared with these entities.
Legal Basis for Processing Personal Data
UVVE will use as a legal basis for the processing of personal data:
Execution of contract and/or regular exercise of rights in an educational services provision contract;
Compliance with legal or regulatory obligations;
Consent, when required;
Regular exercise of rights in judicial, administrative or arbitration proceedings;
Credit protection;
Legitimate interests of UVVE or contractually bound third parties.
Information Security
UVVE will apply reasonable administrative and technological measures to protect the personal data of the Student and Related Holders against breaches of confidentiality, integrity or availability.
6.1. Relevant security incidents will be communicated to the Student and the ANPD in accordance with the regulations.
Student Duties
The student must:
Follow the instructions provided by UVVE or educational platforms, registration, contracts and regulations, protecting your access credentials and keeping your devices updated.
Use educational platforms appropriately, avoiding abusive or fraudulent behavior.
Authorization for Use of Image and Voice
The Student hereby authorizes UVVE to capture and use his/her image and voice during classes, academic events and other activities carried out on the Institution's online platforms or in person, exclusively for educational and institutional purposes.
UVVE may record, store and make classes available online for academic review and teaching improvement purposes, ensuring privacy and data protection in accordance with the LGPD.
Students who do not wish to have their image displayed in live broadcasts may deactivate their camera, according to the settings of the platform used.
If the Student wishes to revoke the authorization to use their image and voice, they must formalize their request by email to UVVE, procuraria@universidadelivre.org, and such revocation will not have retroactive effects on materials already published.
This Term reflects UVVE's commitment to the transparency and security of its students' data, ensuring compliance with the LGPD and other applicable regulations.
